Terms and Conditions
Last updated: October 13, 2026
1. About These Terms
Rosetta Educational Designs, LLC, a Washington limited liability company doing business as Rosetta Marketing Designs, operates this website. In these Terms, “RMD,” “we,” “us,” and “our” refer to that company.
These Terms address use of rosettamarketingdesigns.com, its public resources, and associated forms that link to these Terms.
“You” and “your” refer to the person using the website. If you submit information or enter into an agreement on behalf of an organization, you represent that you have authority to do so.
2. Website Use and Acceptance
Please read these Terms before using our website or submitting information through it.
Where we ask you to accept these Terms through a checkbox, signature, or another clearly identified acceptance step, completing that step indicates your agreement.
Browsing the website, submitting an inquiry, or requesting a free review does not by itself create a paid-service agreement.
You may use the website for lawful personal and internal business purposes, subject to these Terms and applicable law.
3. Paid Services and Client Agreements
RMD provides marketing strategy, website services, CRM implementation, automation, content, search visibility, and related business support.
Paid services are governed by the applicable written service agreement, statement of work, order, or subscription terms accepted by you and RMD.
Those documents establish the services included, responsibilities, deliverables, fees, payment schedule, timelines, ownership rights, cancellation terms, and other conditions of the engagement.
If these website Terms conflict with an applicable client agreement, the client agreement controls the services and transaction covered by that agreement.
General descriptions on this website do not expand the scope of an agreed engagement.
4. Fees, Payments, and Subscriptions
Fees, deposits, milestone payments, recurring charges, applicable taxes, and payment deadlines are established in the applicable agreement or clearly disclosed purchase terms.
Refunds, cancellations, renewals, and termination of paid services are governed by those terms and applicable law. These website Terms do not impose a blanket non-refundable policy.
Where recurring services are offered, the applicable terms will identify the billing frequency, renewal arrangements, cancellation process, and any required notice.
Third-party costs, including advertising spend, software licenses, hosting, domains, and other platform charges, will be identified in the applicable agreement or separately approved.
You must be authorized to use any payment method you provide.
Changes to publicly displayed pricing do not change an existing client agreement unless permitted by that agreement or agreed to by both parties.
5. Free Lead Generation Reviews
Our Free Lead Generation Review examines the areas described on the review page, including positioning, the inquiry path, and follow-up.
The review relies on information you provide and information available to us when we conduct it. Please provide accurate information and identify any relevant limitations.
The review provides observations and recommendations within its stated scope. It does not guarantee a particular business result.
Requesting or receiving a free review creates no obligation to purchase services. Any subsequent paid work requires a separate agreement.
The scope and delivery timing stated on the review page at the time of submission apply to your request.
6. Information and Materials You Submit
You retain ownership of the information and materials you submit, including business descriptions, documents, photographs, branding, and other content.
You grant RMD limited, non-exclusive permission to receive, store, review, copy, and use those materials as reasonably needed to:
Respond to your request.
Conduct a requested review.
Prepare a proposal.
Deliver agreed services.
Maintain related business records as described in our Privacy Policy or required by law.
This permission includes necessary processing by service providers acting on our behalf, subject to applicable agreements and our Privacy Policy. It does not transfer ownership of your materials to RMD.
You represent that you have the rights or permission needed to provide the materials and authorize their intended use.
Ownership and licensing of work created during a paid engagement are governed by the applicable client agreement.
7. Privacy and Non-Public Business Information
Our Privacy Policy explains how we collect, use, retain, and share personal information.
We handle non-public business information submitted through our inquiry, review, and onboarding processes for the purposes associated with your request or engagement.
Submitting business information does not give RMD unrestricted permission to publish it or use it in unrelated promotional materials.
We may share information with providers who need it to support your request or agreed services, or disclose it where required or permitted by applicable law, consistent with our Privacy Policy and relevant agreements.
Additional confidentiality obligations may be established in a client agreement or separate confidentiality agreement.
8. Communications
When you contact us or submit a form, we may respond about your request and send communications needed to administer an agreed service.
These Terms do not provide blanket consent for promotional email or text messages. Where consent is required, we will request it through the applicable communication or signup process.
You may opt out of promotional communications using the instructions provided in those communications or by contacting us.
An opt-out from promotional messages does not necessarily stop communications needed to administer an active agreement.
9. Website Content and Intellectual Property
Unless otherwise identified, website content, branding, graphics, and other materials belong to RMD or their respective owners and licensors.
You may view and use public website materials for personal or internal business reference. You may also share links to public pages.
Except where permitted by law, a specific resource license, or written permission, you may not sell, redistribute, modify, or republish our materials, remove ownership notices, or present our work as your own.
Third-party trademarks, materials, and software remain subject to their owners’ rights and applicable licenses.
These Terms do not change ownership or licensing rights established in a client agreement.
10. Acceptable Use
You must not use our website or forms to:
Violate applicable law or another party’s rights.
Submit fraudulent information or impersonate someone else.
Send spam, malicious software, or harmful content.
Obtain unauthorized access to accounts, systems, or information.
Harvest personal information without authorization.
Interfere with the website’s security, availability, or operation.
Submit materials you lack permission to use.
Harass, threaten, or abuse others.
We may restrict website access when reasonably necessary to address misuse, security concerns, or legal requirements.
Suspension or termination of paid services is governed by the applicable client agreement.
11. Links and Third-Party Services
You may link to our public pages provided the link does not falsely imply our endorsement, misrepresent your relationship with us, or reproduce our website through unauthorized framing.
Our website may link to third-party websites or use third-party tools for forms, scheduling, payments, and other functions.
Those providers operate under their own terms and privacy policies. We do not control their independent websites or guarantee their content or availability.
Responsibilities for selecting, configuring, managing, and supporting third-party tools during a paid engagement are governed by the applicable client agreement.
12. Testimonials, Case Studies, and Recordings
Testimonials and case studies describe particular experiences. Results vary with the business, market, implementation, resources, and other circumstances.
We obtain appropriate permission before using non-public client materials, identifiable private feedback, or recordings in promotional content.
Permission to record a meeting or conversation does not automatically authorize public or promotional use of that recording.
Recording notices and permissions will be handled for the specific activity in accordance with applicable law. Event participation or website use does not grant RMD a perpetual appearance release.
13. Recommendations and Business Results
Our website materials and reviews provide marketing and business information within their stated scope.
We make reasonable efforts to keep that information accurate and useful. Recommendations depend on the information available and may need to change as circumstances evolve.
Unless expressly stated in an applicable agreement, RMD does not guarantee a specific number of leads, appointments, enrollments, clients, sales, or revenue, or a particular search ranking or inclusion in AI-generated search answers.
Examples and testimonials do not establish a guarantee for another business.
Website materials and free reviews do not replace advice from qualified legal, tax, or other professional advisers where that advice is needed.
14. Website Availability and Liability
Public website content is provided on an “as available” basis. We do not guarantee uninterrupted access or that every public resource will be error-free.
To the extent permitted by applicable law, RMD is not liable for indirect, incidental, special, or consequential losses arising solely from use of this public website or its free informational materials.
This provision does not limit liability that cannot lawfully be excluded, including liability for fraud, willful misconduct, or gross negligence where applicable.
It also does not replace service commitments, warranties, remedies, or liability provisions in an applicable client agreement.
Nothing in these Terms excludes rights or remedies that applicable law requires us to preserve.
15. Responsibility for Unlawful Use
To the extent permitted by law, you agree to indemnify RMD against third-party claims and reasonable related expenses arising from your unlawful use of this website or your submission of materials that infringe another party’s rights.
This obligation does not apply to the extent a claim results from RMD’s negligence, willful misconduct, or unauthorized use of your materials.
Any indemnification obligations relating to paid services are governed by the applicable client agreement.
16. Copyright and Other Rights Concerns
If you believe material on this website infringes your copyright or another protected right, contact info@rosettamktg.com.
Please identify the material, its page location, the right you believe is affected, and your contact information. Include supporting information sufficient for us to evaluate your concern.
We will review the request and respond as appropriate under applicable law.
This contact process does not replace any statutory notice requirements that apply to a particular claim.
17. Changes to These Terms
We may update these Terms to reflect changes to the website, our business, or applicable requirements.
The revised version and its updated date will appear on this page. Where additional notice or acceptance is required by law, we will provide it.
Changes to these website Terms do not automatically amend an existing client agreement. Amendments to paid-service agreements follow the process established in those agreements.
18. Governing Law and Disputes
These Terms are governed by Washington State law, subject to applicable federal law and mandatory legal protections.
Subject to jurisdictional requirements, disputes relating to these website Terms may be brought in the state courts located in Whatcom County, Washington, or the United States District Court for the Western District of Washington.
This provision does not limit any mandatory right to bring a claim in another jurisdiction or seek a remedy available under applicable law.
Disputes concerning paid services are governed by the dispute provisions of the applicable client agreement. These website Terms do not impose mandatory arbitration.
19. General Provisions
If a provision is found unenforceable, the remaining provisions continue to apply to the extent permitted by law.
A failure to enforce a provision on one occasion does not waive the right to enforce it later.
These Terms address website use. Our Privacy Policy addresses personal-information handling, and applicable client agreements address paid services. These Terms do not supersede a signed client agreement.
